Page title: Terms and Conditions · Shopify slug: terms-of-service
1. Scope
(1) These Terms and Conditions ("Terms") establish the rules governing every transaction made through the online shop at novrix.com between the operator of novrix.com (hereinafter "NOVRIX", "we", "us") and the client (hereinafter "you", "Client"). Our offer covers goods in the home and garden categories.
(2) A consumer for the purposes of these Terms is any natural person who concludes a legal transaction for purposes that are predominantly unrelated to any commercial or self-employed professional activity. A business client is any natural or legal person, or partnership with legal capacity, who acts in the exercise of their trade or independent professional capacity when the contract is formed.
(3) Any deviating, conflicting or supplementary general terms presented by the Client shall only form part of the agreement where their validity has been expressly confirmed by us in writing.
2. Contracting Party and Contact
The purchase contract is formed between you and the operator of NOVRIX. Full provider details are set out on our Legal Notice page.
Customer support: contact@novrix.com
3. Conclusion of Contract
(1) The listing of our home and garden goods in the online shop does not constitute a legally binding offer; it serves solely as a non-binding online catalogue.
(2) By clicking the "Buy" / "Place order" / "Pay now" button, you submit a binding offer to purchase the items in your shopping basket.
(3) Acknowledgement of receipt and acceptance of your order are sent simultaneously — you will receive both immediately after placing your order by means of an automatically generated email. Upon despatch of that confirmation email, the purchase contract becomes legally binding.
(4) We retain the contract text and send it to you together with these Terms by email. The Terms currently in force are accessible at any time at novrix.com/terms-of-service.
(5) Contracts are concluded in the English language.
4. Prices and Shipping Costs
(1) All prices shown on the website are inclusive of the applicable statutory Value Added Tax. Any delivery charges are set out separately during the checkout process.
(2) For shipments to countries outside the European Union and the United Kingdom, customs duties, local taxes and further charges may arise; these are the sole responsibility of the Client.
(3) Full details of delivery charges and estimated shipping windows are provided on our Shipping & Payment page.
5. Payment Terms
(1) The following payment methods are available: credit card (Visa, Mastercard, American Express), PayPal, Klarna, Apple Pay, Google Pay and bank transfer. We reserve the right to exclude individual methods in specific circumstances.
(2) The full purchase price falls due upon conclusion of the contract.
(3) Where payment is made by credit card or PayPal, your account will be debited immediately upon completion of the order.
6. Delivery
(1) Goods are despatched to the delivery address supplied by the Client. The applicable delivery windows are displayed on each product page and throughout the checkout process.
(2) Should delivery prove impossible after three attempts, we are entitled to withdraw from the contract. Any sums already paid will be returned to you without delay.
(3) Where force majeure causes a delay, the delivery period will be extended proportionately. We will notify you of any such development as promptly as possible.
7. Retention of Title
All goods delivered remain our property until the full purchase price has been received.
8. Right of Cancellation for Consumers
Consumers are entitled to a statutory right of withdrawal. Full cancellation details and the model withdrawal form can be found on our Cancellation Policy page.
9. Warranty and Liability for Defects
(1) The statutory provisions on defect liability apply. For consumers, the limitation period for defect-related claims is two years from the date of delivery.
(2) For second-hand goods, this period is reduced to one year from the delivery date.
(3) Should any delivered item arrive in a defective condition, please write to us at contact@novrix.com.
10. Liability
(1) We accept unlimited liability in cases of intent and gross negligence, and within the framework of applicable consumer protection legislation.
(2) In cases of ordinary negligence, our liability is limited to breach of a fundamental contractual obligation — one whose fulfilment is essential to the proper execution of the contract and upon which the Client may reasonably rely. In such instances, liability is capped at foreseeable, contract-typical loss.
(3) Liability for injury to life, limb or health remains unaffected by the foregoing.
11. Dispute Resolution
(1) The European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
(2) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body.
12. Applicable Law and Jurisdiction
(1) The contractual relationship is governed exclusively by the laws of England and Wales, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. In relation to consumers, this choice of law applies only insofar as the protection conferred by mandatory provisions of the consumer's country of habitual residence is not thereby withdrawn.
(2) Where the Client is a merchant, a body corporate under public law or a public-law special fund, the courts at our registered office shall have exclusive jurisdiction over all disputes arising from this relationship.
13. Final Provisions
Should any provision of these Terms be or become wholly or partially void, the validity of the remaining clauses shall not be affected. The relevant statutory rule shall substitute any invalid provision.
